Understanding California’s new employment laws for 2022

The publication of the Essentials October edition marks the end of the California’s legislative session. In that are updates to California’s employment laws for next year. The following details a few of the updates.

Sexual discrimination and harassment claims

For claims initiated after the new year, the law extends the prohibition already in place against disclosure of acts of harassment and discrimination in the workplace that are not based on sex.

Wage theft now prosecuted as grand theft

Wage theft in amounts above $950 for any one employee or $2,350 for two or more workers in any 12-month period can now be prosecuted as a felony or misdemeanor, with the recovery of wages or other compensation considered restitution.

Quotas for warehouse distribution centers

Starting Jan. 1, 2022, employers of warehouse distribution centers employing more than 100 workers (or more than 1,000 if the company has multiple warehouse distribution centers), employers must provide a written description of quotas to employees, and the quotas must not interfere with required meal and restroom breaks. There are also provisions regarding employee health and safety.

These are but a few of the changes affecting California employment law for the upcoming year.
